Please read and understand these Terms and Conditions before using VitalityWellness Fort Worth.com. By using this site and the related web pages of Vitality Wellness Med Spa and/or its various subsidiaries, you accept and agree to be bound and abide by the following Terms and Conditions. If you do not agree with these Terms and Conditions, you must not access or use this site and the related pages.

VITALITY WELLNESS POLICIES: 

The content provided on this website should be used for informational purposes only.  This website is not intended to provide medical information and should not be relied upon by any person for any medical, diagnostic or treatment reasons.  Any results shared by past clients or third party testimonials may not be typical. Individual results may very.

  • Refund/cancellation policy - All booking fees paid online or over the phone are non-refundable.  Once paid, there is no refund for cancelling or changing your mind.  Once booked, the fee is completely liquidated. Paying the $50 booking fee confirms your appointment date and time in our system. You will see the booking fee appear as "Vitality Wellness" on your bank or credit card statement. You may cancel an appointment within 24 hours BEFORE your scheduled appointment by calling our office at (682) 233-6131.  If you change your appointment date and time *before* 24 hours of your scheduled appointment, the booking fee is non-refundable, but you can reschedule your appointment date and time by calling (682) 233-3161.  If you do not show up for your appointment at the scheduled time and day or cancel completely, the booking fee will be liquidated and the booking fee will not be applied to another booked appointment in the future.

  • Fulfillment - All booking fees, appointment and product pick-ups are for in-office appointments at Vitality Wellness Med Spa Office at 1201 Summit Ave #400 Fort Worth, TX 76102. You can change an appointment 24 hours before your scheduled appointment time to re-schedule with no additional fee.  Any appointment cancelled from an online booked appointment or a phone scheduled appointment within 24 hours of the scheduled appointment will result in a liquidated booking fee. A new appointment must be made (including a new $50 booking fee) paid online or over the phone.

  • Privacy- By accepting our site cookies, we collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history. We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page. We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile. * We never sell your information*

  • Use of Site- This site and the content provided in this site cannot be reproduced, copied, shared, uploaded or distributed without permissions from Vitality Wellness Med Spa including any text, graphics, audio or video, digital downloads or testimonials.  You agree to not use any device or software to interfere or attempt to interfere with the proper working of this site. You agree that you will not take any action that imposes a burden or load on our infrastructure that Vitality Wellness Med Spa.

  • Links- We share third party videos and testimonials to give prospective clients information about our services and technology. This third party information is delivered as a convenience and not endorsed by Vitality Wellness Med Spa. Vitality Wellness Med Spa is not responsible for the accuracy, products, or content from these third party sites and will not be held liable or responsible for the information shared.  You acknowledge and agree that Vitality Wellness Med Spa shall not be liable for any damage or loss arising related to your use of such sites or reliance on any such content, products or services available from these other third party sites.

  • Limitation of Liability- Except as expressly provided in this agreement, neither Vitality Wellness Med Spa shall be liable to any other Party for any indirect, incidental or consequential damages (including without limitation, damages resulting from loss of use, loss of profits, interruption or loss of business, lost goodwill, lost revenue and lost opportunity) arising out of any of the terms or conditions of this agreement or with respect to its performance hereunder. The foregoing limitation of liability and exclusion of damages applies even if a Party had or should have had knowledge, actual or constructive, of the possibility of such damages. The foregoing limitation of liability and exclusion of damages shall apply whether a claim is based on breach of contract, breach of warranty, tort (including negligence), product liability, strict liability or otherwise, and notwithstanding any failure of essential purpose of any limited remedy herein.

  • Changes to the Terms and Conditions- Vitality Wellness Med Spa reserves the right to change our Terms and Conditions without notice. All changes are effective immediately when posted and apply to any use of this site thereafter. However, any changes to the governing law and dispute resolution provisions set forth below will not apply to any disputes for which parties have actual notice on or before the date the change is posted on the site.

  • Indemnification-You agree to indemnify, defend and hold harmless Vitality Wellness Med Spa and its directors, doctors, RNs, officers, associates, agents, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses and fees (including reasonable attorney fees) arising out of or relating to your violation of these Terms and Conditions or your use of this site.

  • Governing Law & Location of Dispute Resolution- All matters relating to this site and these Terms and Conditions and any dispute or claim arising therefrom or related thereto shall be governed by and construed in accordance with the laws of the United States of America and of the State of Texas (without regard to conflict of law principles). The language herein shall be interpreted as to its fair meaning and not strictly for or against any party. You consent and submit to the exclusive jurisdiction of the state and federal courts located in Tarrant County, the State of Texas, United States of America, in all questions and controversies arising out of your use of this site and these Terms and Conditions. You expressly submit to the jurisdiction of said courts, and you consent to extraterritorial service of process. To the extent allowed by applicable law, any claim or cause of action arising from or relating to your access or use of this site must be brought within [two] years from the date on which such claim or action arose or accrued.

  • Waiver and Severability- No waiver by Vitality Wellness Med Spa of any term or condition set forth herein shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Vitality Wellness Med Spa to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of these Terms and Conditions will continue in full force and effect.
